An ACP-5 is a document filed with the New York City Department of Environmental Protection (NYCDEP) that is used to inform them along with the New York City Department of Building (NYCDOB) that a building construction project does not require a small or large asbestos abatement to be performed prior to the construction project initiation.
ACP stands for Asbestos Control Program. The Asbestos Control Program is a program of the NYCDEP that ensures compliance with the Title 15 Chapter 1 of the Rules of the City of New York. This section regulates asbestos building materials in New York City and how it must be properly engaged with. If a building does not have any asbestos containing materials or the portions of the building being affected by the construction project does not have any asbestos containing materials, a New York City certified asbestos investigator can submit the ACP-5 form to the NYCDEP which can then be used to secure the NYCDOB building permit. An ACP-5 form may also be submitted if asbestos containing materials will be affected by the construction project but the quantity of materials affected only constitutes a minor abatement project.
